A Guide for Injured Employees

Work injuries should be fairly simple. Your employer should pay for all your medical expenses and lost wages during the time you are unable to work. However, it's more complicated than that. Failure to perform certain steps after a job injury can cause your employer and their insurance company to fight your claim and refuse to pay.

I've Been Hurt at Work. Now What?

After being injured at work, you must:

  • Notify your employer of your injury — Immediately inform your superior of the accident or injury. Although verbal notification is sufficient, filling out a written report may be helpful.
  • Seek medical attention — When you are injured at work, your employer's insurance company pays for your medical bills. Although your employer may suggest a certain doctor, you have the right to see any physician. Failure to see a doctor could result in your employer denying your claim, arguing you must not have been hurt badly if you did not seek immediate medical attention.
  • Do not give a recorded or written statement — Making or signing statements could affect your claim. To be safe, do not record or sign any documents without consulting with an attorney.
  • Contact an experienced workers' compensation lawyer — Because the workers' compensation system can be difficult to navigate, it is important that you have an experienced attorney on your side. Contact my office to discuss your situation.
  • Record the names of any witnesses — After time passes, evidence, including witnesses' names, can be forgotten. Write down the names of anyone who saw your accident and collect statements, possible.
